Terms and conditions

The terms of use and sale for axiris.ai: the account, the credits, payment, your creations and what is prohibited.

1. Purpose

These terms govern the use of the axiris.ai website and of the online service for creating images and videos by artificial intelligence ("the service"), operated by Kris Wilhem, sole proprietorship Axiris ("Axiris", "we"), whose contact details appear in the legal notice. They apply to every person who creates an account ("you").

By creating an account or buying credits, you accept these terms.

2. The account

One account, one e-mail address, one person. You open an account with an e-mail address, confirmed by a link, or with a Google account. The name chosen at sign-up is fixed. You keep your password to yourself and you are responsible for what is done from your account.

Age. The service is reserved for persons aged 18 and over.

Access. A new account receives access to image generation and a one-time gift of credits, to try the service. Other services (video, rooms, Nova) may be opened depending on the account. Axiris may change the services open to an account.

Suspension. We may suspend or close an account that breaches these terms, in particular article 6. Purchased and unused credits of an account closed through no fault of yours are refunded.

3. Credits

What a credit is. Generations and certain services (such as conversations with Nova) are paid in credits. The cost is displayed in the application before you start.

How a credit is spent. Credits are reserved when you start a generation and debited only once the result is there. If the generation fails, they are returned to you automatically. A balance never goes negative.

Gifted and earned credits. Credits gifted at sign-up and credits earned in the gallery (for example through "likes") have no monetary value: they are not refunded, not converted into money and not transferable. Axiris may adjust or cap these earnings, for example to prevent abuse.

Duration. Credits do not expire as long as the account exists.

4. Reserved slots

A reserved slot places the generation machine at your sole disposal for the duration purchased. If an outage on our side causes you to lose more than 5 minutes of a paid slot, the lost minutes are returned to you as a credit note, usable on a future booking. Cancellation conditions are set out on the Refunds page.

5. Prices and payment

Prices are shown in Swiss francs (CHF) in the application, before purchase. As Axiris is not subject to VAT, no VAT is charged.

Payment is made by card, on a payment page operated by Stripe. Credits are added to your account as soon as Stripe confirms the payment. A receipt is sent to you by e-mail.

Subscriptions, where offered, renew each period and may be cancelled at any time; cancellation takes effect at the end of the paid period.

6. What is prohibited

You may not use the service to create, upload or distribute:

• sexual or pornographic content;
• any content involving minors in an inappropriate manner;
• the likeness of a real person without their consent, or in order to deceive, harass or defame them;
• illegal, violent or hateful content, or content that incites violence;
• content that infringes the rights of others (copyright, trade marks, image rights);
• forged documents or content intended to deceive.

It is also prohibited to circumvent the limits of the service, to automate accounts, to create several accounts in order to accumulate gifted or earned credits, or to disrupt the service.

7. Your creations

They are yours. You retain the rights to what you create with the service, within the limits of the licences of the models used and of third-party rights over what you supply (reference images, logos, texts).

What you supply. You warrant that you have the right to use the images, texts and references you upload.

What we do with them. You authorise us to store and process your creations in order to provide the service to you. We do not use them to train models and we do not publish them without an action on your part.

The gallery. If you publish an image in the gallery, you authorise us to display it publicly, with your username and its description, until you withdraw it.

The recipe stays with us. Delivered images keep their settings (model, prompt, steps, seed); the workflow that produced them stays on our servers.

8. AI models

The service relies on artificial intelligence models, our own and those of third parties. Their results may be inaccurate, imperfect or unexpected: you check what you use. When you choose a model from a third-party provider, your request is passed on to that provider and its own terms may apply.

9. Availability and liability

We do our best to keep the service available, without being able to guarantee it at all times. It may be interrupted for maintenance or in the event of an outage. An interrupted generation costs you nothing (article 3); a lost reserved slot is returned to you (article 4).

Within the limits of the law, the liability of Axiris is limited to direct damages, and at most to the amount you have paid over the last 12 months. Cases of wilful misconduct or gross negligence are not limited.

10. Changes

We may change these terms. The version in force is the one published on this page, with its date. Significant changes are announced in the application before they apply.

11. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is the registered office of the operator, subject to the mandatory places of jurisdiction provided by law for consumers.
